Supplemental Terms of Use – TDM Studio

In addition to the standard Terms and Conditions and applicable Product Service Terms to the license and use of the underlying ProQuest research databases, the following supplemental terms apply to use of TDM Studio and any output therefrom, including the export restrictions noted below.

- Permitted Uses. Notwithstanding the general prohibition on text and data mining under the Terms and Conditions, Authorized Users are expressly allowed within the designated TDM Studio Workbench to create derived data from the textual content of the eligible databases. Such derived data may include summaries of, and factual extracts from, the editorial content and metadata in the eligible databases provided that the derived data is non-infringing, cannot reasonably be considered a substitute for reading the full-text story, and does not violate any applicable law (“Derived Data”). Customer and its Authorized Users may export and use the Derived Data solely for teaching, learning, research and analysis – including publication of research results and peer review. Neither Customer nor its Authorized Users may resell or make commercial use of TDM Studio, any of the eligible materials from the ProQuest databases, or the Derived Data.
- Customer Responsibilities. Customer and its Authorized Users shall maintain the confidentiality of the passwords or other authentication methods used by Authorized Users. Customer and its Authorized Users are responsible for compliance with all applicable laws (including privacy and data protection regulations) with respect to the Derived Data created as well as with respect to any content, scripts or other materials uploaded by Authorized User(s).
- TDM Studio Workbench – Additional Authorized Users. Customer may designate collaborating scholars from other institutions as Authorized Users with respect to a specific TDM Studio Workbench.
- Citation and Index Record Export. The citation and index record export provided as part of TDM Studio are made available for use by Authorized Users for teaching, learning, research and analysis. Once exported, the citations and index records remain subject to the Terms and Conditions applicable to the license and use of the ProQuest research databases from which the citation and index records are produced, except that Customer and its Authorized Users may use such citation and index records in a locally loaded corpus for text and data mining by Authorized Users solely during the term of the Customer’s TDM Studio subscription. Following the TDM Studio subscription expiration, Customer and its Authorized Users may (a) retain the citation and index records for the reference of Authorized Users who have exported the results; and (b) retain and use any Derived Data produced therefrom. Neither Customer nor its Authorized Users may redistribute, resell or make commercial use of the citation and index records exported from TDM Studio.
- Export Restrictions. Certain publishers prohibit the export of any model, technology, algorithm, platform, or application that is developed, improved, or trained in TDM Studio using their published content.
